Position Objective
The role of the Risk & Compliance Officer is to assist the company in the implementation of the company’s Compliance Program, promoting and evaluating compliance issues and internal controls within the company to ensure that the company is conducting its business in full compliance with local and where necessary, international laws and regulations.
Key Responsibilities
Assist in carrying out the company’s business compliance program and keeping the company’s business dealings ethically sound and legal at all times to prevent illegal, unethical, or improper conduct
Have knowledge on AMLATFA requirements and attend to comprehensive checks in respect of on-boarding clients and customer due diligence, ensuring all sanctions and watch lists are processed efficiently and assist in documentation review e.g. trust deed, custody agreement, and any other agreements that binds the company etc.
Assist in developing, initiating and revising policies and procedures for the general operation of the company’s compliance program and strive to educate the entire company to maintain the highest level of compliance
Perform a periodical review process on all compliance issues and policies in the company, monitor and manage deviations of company portfolio of cases as and when necessary
Work with all both external (fund managers, professional firms, regulatory agencies, etc.) and internal stakeholders to ensure smooth and proper running of the trustee business, e.g. compliance pertaining to the unit Trust Industry, Private Retirement Scheme, resolution of breaches, meeting all required reporting on a timely basis, organize and present compliance updates and issues during board meetings to keep members of the board updated when necessary
Stay abreast of current market and regulatory developments in the fiduciary and fund services industry and analyze the opportunities and challenges of these developments
Assist in conducting annual due diligence and monitor performance of all agents (internal and external) in compliance with applicable policies and guidelines
Assist in managing relationship with regulators, namely Securities Commission, Bank Negara Malaysia, Registrar of Companies and any other regulators (if any)
Strong writing skills, are required in providing and editing policies and procedures, reports and memorandums for discussion, attend to proper reporting of violations or potential violations upon obtaining the approval of the Chief Executive Officer and/or directly to members of the board if necessary
Monitor the performance of the compliance program and updating the existing compliance manuals on a continuing basis and take appropriate steps to improve its effectiveness and adopt new manuals where necessary and/or required
Assist in identifying potential areas of compliance vulnerability and risk and to develop and implement corrective action plans to avoid or deal with similar situations in the future
Conduct in house training for staff on a regular basis to ensure that the staff and management are kept informed of new guidelines and requirements by the regulators
To ensure timely reporting of staff non-compliance, raise concerns of non-compliance or suspicious activity to the relevant Head of Departments
Be proactive to ensure avoidance of potential breaches in compliance
Attend to the Securities Commission’s reporting as and when required
To conduct internal audits on the company to ensure conformity to the Securities Commission’s Guidelines The potential candidate should be ethical, principled, diligent, be willing to keep learning and be able to keep up with constantly changing legislation, guidelines and laws to ensure that the integrity of the company’s business is maintained at all times.
